How offers on your home are handled
The Saskatchewan Real Estate Act requires a seller’s brokerage to present all written offers that we receive on a seller’s property. Offer presentations can happen by phone, by fax, by email or in person but verbal negotiations are prohibited and have no binding power under the law. Therefore, your signature (and the signature of any other registered title holder) will be required to actually make anything happen. The standard offer to purchase in Saskatchewan allows fax copies, so if you happen to be doing this from another area we definitely have ways to facilitate a written offer and our toll free fax service makes it a snap to return required documents.
Once received, all written offers will be quickly presented to you using the method of conveyance that you prefer. Our policy, implemented to avoid potential misunderstandings is to speak with our sellers when an offer is presented, either by telephone, or in person. We will walk through the offer with you to ensure that you precisely understand the terms and conditions of the offer, and using our experience gained through hundreds of other transactions over nearly sixteen years, we’ll provide you with appropriate advice to protect your interests and strengthen your negotiating position.
A seller has three options available to them when considering written offers. They may accept the offer as it has been written if they feel it’s in their best interest to do so, they may make a written counter-offer which proposes to the buyer certain changes, or they may reject an offer outright without sending back any kind of a counter-proposal.
The primary items that you’ll be considering are price, amount of deposit, and conditions of the offers, possession date and any personal items that the buyer may have elected to “include” in their offer. You should be aware that items that are fixed or attached to the property in any way are considered “fixtures” and are assumed to be staying with the home unless otherwise specified in the offer document. Examples include items like light fixtures, curtain rods, attached blinds, towel bars, door knobs and other hardware, installed flooring, cabinets, attached shelving, bathroom fixtures, and built-in appliances (dishwasher, central vacuum, garage door opener, etc.).
